The Membership Agreement and Terms of Use

Welcome to Beautiful People Only ("BPO", "we", "us", or "our"). These Terms of Service ("Terms") constitute a legally binding agreement between you and Beautiful People Group governing your access to and use of the Beautiful People Only platform and all related services.
1. Acceptance of Terms
By creating an account, accessing the platform, or using any service provided by Beautiful People Only, you agree to these Terms in their entirety. If you do not agree, you must immediately cease all use.
2. Eligibility
To use Beautiful People Only, you must meet all of the following requirements:
- You must be at least 18 years of age
- You represent that you have passed our third-party biometric age verification
- You must have legal capacity to enter into a binding agreement
- You must not be prohibited from using the service under applicable laws
3. Mandatory Binding Arbitration
BY ENTERING THIS SITE, YOU AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING FROM YOUR USE SHALL BE SETTLED EXCLUSIVELY BY BINDING ARBITRATION IN NORTH MIAMI BEACH, FLORIDA.
YOU HEREBY WAIVE YOUR RIGHT TO A TRIAL BY JURY.
YOU HEREBY WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS-ACTION LAWSUIT.
Arbitration shall be administered under the rules of the American Arbitration Association (AAA). This arbitration clause survives the termination of your account.
4. Limitation of Liability (The $100 Cap)
IN NO EVENT SHALL BEAUTIFUL PEOPLE ONLY, ITS FOUNDER, OFFICERS, DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
Our total aggregate liability for any claim—whether arising from data breach, loss of earnings, service interruption, or technical failure—is strictly capped at ONE HUNDRED DOLLARS ($100.00 USD).
This cap applies regardless of the legal theory under which the claim is asserted.
5. Indemnification (The Shadow Shield)
You agree to indemnify, defend, and hold harmless Beautiful People Only, its founder, and all affiliates from any and all claims, losses, damages, liabilities, and legal fees (including reasonable attorney's fees) arising from:
- Your content posted on the platform
- Your conduct on or off the platform
- Your violation of these Terms
- Any third-party claims related to your use of the service
If a creator or member's actions result in legal action against the platform, that user is legally required to pay for all legal defense costs and court fees.
6. Account Registration
When you create an account, you agree to:
- Provide accurate, current, and complete information
- Maintain the security of your password and account
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access
7. Creator Terms
Creators retain full ownership of their content. By uploading, you grant BPO a non-exclusive, worldwide license to host, display, and distribute your content on the platform.
- Creators earn 90% of all revenue (subscriptions, PPV, tips, messages)
- BPO retains a 10% platform commission
- Payouts are processed weekly with a $20 minimum
- New earnings are subject to a 7-day hold for chargeback protection
8. Fan / Subscriber Terms
As a fan or subscriber, you agree to:
- Pay all subscription fees and purchases as agreed
- Do not redistribute, share, or resell any content
- Respect creators' boundaries
- Report any unauthorized distribution
9. Content Policy
The following content is strictly prohibited:
- Content involving minors in any capacity
- Non-consensual content
- Content that infringes on intellectual property rights
- Content promoting illegal activities
- Hate speech
- Spam or phishing
10. Physical Goods & Shipping
All "Signature Series" physical purchases (glassware, elixirs, fragrances, gift baskets) are FINAL SALE.
- Risk of loss transfers to the member upon delivery to our Third-Party Logistics (3PL) carrier
- Fragile goods (glass bottles, limited-edition items) are packaged by our specialized fragile-goods logistics partner
- BPO is not liable for damage occurring during transit after handoff to the carrier
- Members may select "White-Glove Priority Shipping" for premium handling
11. Payments & Fees
All payments are processed via Stripe. All fees are listed in USD. Refunds are handled on a case-by-case basis per our refund policy.
12. Prohibited Conduct
You agree not to:
- Use the platform for any illegal purpose
- Impersonate any person or entity
- Circumvent, disable, or interfere with security features
- Scrape, harvest, or collect user data without authorization
- Upload viruses, malware, or other harmful code
- Engage in any activity that disrupts the platform
- Use automated systems (bots) to access the platform
- Download, copy, or redistribute creator content
13. Termination
We may suspend or terminate your account at any time, with or without cause, with or without notice. For creator accounts, any pending earnings will be paid out according to our standard payout schedule, minus any applicable fees or chargebacks.
14. Governing Law
These Terms are governed by the laws of the State of Florida. All disputes shall be resolved through binding arbitration in North Miami Beach, Florida.
