1. Overview
Beautiful People Only ("BPO") complies with the Digital Millennium Copyright Act (DMCA) and responds promptly to notices of alleged copyright infringement. We take intellectual property protection seriously and have implemented robust measures to protect creator content.
If you believe that your copyrighted work has been copied and is accessible on our platform in a way that constitutes copyright infringement, please follow the procedures outlined below.
2. Filing a DMCA Takedown Notice
To file a DMCA takedown notice, send a written notification to our designated DMCA agent that includes all of the required elements listed in Section 3 below. Notices can be submitted via:
- Email: dmca@beautifulpeopleonly.com
Upon receiving a valid DMCA notice, we will:
- Promptly remove or disable access to the allegedly infringing content
- Notify the content uploader of the takedown
- Provide the uploader with a copy of the notice and information about filing a counter-notification
3. DMCA Notice Requirements
Your DMCA takedown notice must include the following:
- Identification of the copyrighted work: A description of the copyrighted work you claim has been infringed, or a list of such works if multiple are covered by a single notification
- Identification of the infringing material: The specific URL(s) or description of where the infringing content is located on our platform, with sufficient detail for us to locate it
- Your contact information: Your name, address, telephone number, and email address
- Good faith statement: A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
- Accuracy statement: A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner
- Signature: A physical or electronic signature of the copyright owner or authorized representative
4. Counter-Notification
If you believe your content was removed by mistake or misidentification, you may submit a counter-notification to our DMCA agent. Your counter-notification must include:
- Your physical or electronic signature
- Identification of the content that was removed and the location where it appeared before removal
- A statement under penalty of perjury that you have a good faith belief the content was removed as a result of mistake or misidentification
- Your name, address, and telephone number
- A statement that you consent to the jurisdiction of the federal court in your district and that you will accept service of process from the person who filed the original DMCA notice
Upon receiving a valid counter-notification, we will forward it to the original complainant and restore the removed content within 10-14 business days, unless the complainant files a court action seeking a restraining order.
5. Repeat Infringers
BPO maintains a strict repeat infringer policy. We may, in appropriate circumstances, terminate the accounts of users who are repeat infringers. Our policy includes:
- First offense: Content removal and warning
- Second offense: Content removal, temporary account suspension, and final warning
- Third offense: Permanent account termination
We reserve the right to terminate any account at any time for egregious or willful infringement, regardless of the number of prior offenses.
6. Content Protection Measures
BPO employs multiple layers of technology to protect creator content:
- Signed URLs: All media is served through time-limited, signed CloudFront URLs that cannot be shared
- Invisible Watermarking: Content is digitally watermarked with the purchaser's identity for leak tracing
- Download Prevention: Technical measures to deter unauthorized downloading and screen capture
- DRM Protection: Digital rights management for premium content
- Automated Monitoring: Proactive detection of content redistribution on third-party sites
